Supplementary pension schemes: new rules for the allocation of TFR from 1 July 2026

As of 1 July 2026, the new provisions on automatic enrolment in supplementary pension schemes for employees in the private sector, introduced by the 2026 Budget Law, will come into force. The change concerns the allocation of accruing TFR at the time of hiring and provides for different rules depending on whether the employee is in their first employment or has already had previous employment relationships.

For employees in their first employment, the deadline for expressing their choice regarding the allocation of TFR is set at 60 days from the date of hiring. Within this period, the employee may decide whether to allocate the TFR to a supplementary pension scheme or keep it with the employer. In the absence of an express choice, the automatic enrolment mechanism will apply to the collective pension fund provided for by the collective agreement applied by the company or, failing that, to the residual pension scheme.

For employees who are not in their first employment and who were previously enrolled in a supplementary pension scheme with allocation of TFR, it will be necessary to inform the new employer, within 60 days from the start of the employment relationship, of the pension fund to which the accruing TFR is to be allocated. In such cases, subject to specific exceptions, it will not be possible to opt to keep the TFR with the company.

The reform therefore requires companies to update their hiring procedures, forms and information notices provided to employees at the time of hiring, in order to enable an informed and correct choice within the new statutory deadlines.
