Specifically, the employee must be placed on unpaid leave by means of a written document, dated and signed by the employer, prior to the commencement of the mandate. In the absence of the original document, the employer may still provide statements and supporting documents proving the actual period of leave (e.g., payroll records, single employment ledger, etc.)\u2014which, however, will not be sufficient on their own. <\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/www.hrcapital.it\/wp-content\/uploads\/2025\/08\/shutterstock_1414855505-1024x683.jpg\" alt=\"\" class=\"wp-image-9220\" srcset=\"https:\/\/www.hrcapital.it\/wp-content\/uploads\/2025\/08\/shutterstock_1414855505-1024x683.jpg 1024w, https:\/\/www.hrcapital.it\/wp-content\/uploads\/2025\/08\/shutterstock_1414855505-300x200.jpg 300w, https:\/\/www.hrcapital.it\/wp-content\/uploads\/2025\/08\/shutterstock_1414855505-768x512.jpg 768w, https:\/\/www.hrcapital.it\/wp-content\/uploads\/2025\/08\/shutterstock_1414855505.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>With particular reference to trade union appointments, INPS specifies that such appointments must be formally conferred in writing, in accordance with the organization\u2019s bylaws: to confirm the legitimacy of the leave, what matters is the regularity of the appointment, not the activities actually carried out.
