{"id":4823,"date":"2023-01-18T16:24:17","date_gmt":"2023-01-18T15:24:17","guid":{"rendered":"https:\/\/www.hrcapital.it\/observatory\/lavoro-agile-le-principali-novita-del-2023\/"},"modified":"2023-08-09T14:22:22","modified_gmt":"2023-08-09T12:22:22","slug":"lavoro-agile-le-principali-novita-del-2023","status":"publish","type":"post","link":"https:\/\/www.hrcapital.it\/en\/osservatorio\/remote-working-main-changes-for-2023\/","title":{"rendered":"Remote working: main changes for 2023"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Remote working proved to be  widely used tool during the Covid-19 pandemic, to comply with interpersonal distancing practices and protect \u201cat-risk\u201d employees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once the emergency, which ensured a simplified method to access agile working, ended on 31 December 2022, the ordinary regulation under <strong>Art. 18, of Law no. 81\/2017 <\/strong>applied.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From 1 January 2023, stipulating an individual agile working agreement with each worker covered by the related provisions is mandatory.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Agile working and individual agreements<\/strong><strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">After an <strong>Agile working<\/strong> agreement between worker and employer has been made, work is organised by cycles and objectives, without precise constraints on the workplace or working hours, but following the rest periods under Legislative Decree no. 66\/2003.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The agile working agreement must be <strong>in writing<\/strong> and contain the following elements:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the service <strong>performance method;<\/strong><\/li>\n\n\n\n<li>the performance <strong>monitoring methods<\/strong> carried out by the employer;<\/li>\n\n\n\n<li><strong>rest<\/strong> and right to \u201c<strong>disconnect\u201d;<\/strong><\/li>\n\n\n\n<li><strong>Validity<\/strong> period, which may be fixed-term or <strong>open-ended.<\/strong> <strong><\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Workers who are parents, disabled or caregivers<\/strong><strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSimplified\u201d agile working ending had consequences for those who have children and at-risk workers. The deadline for workers with children <strong>under 14 years <\/strong>who performed agile working without an individual agreement expired on 31 December 2022. Workers with the illnesses set out in the Ministerial Decree of 4 February 2022 and classified as \u201c<strong>at-risk<\/strong>\u201d, can carry out agile working in \u201c<strong>emergency<\/strong>\u201d mode, i.e., without an individual agreement, until <strong>31 March 2023<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ordinary regime allows the following categories of workers to have priority in accessing agile working:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"a\">\n<li>workers <strong>with children up to 12 years<\/strong>;<\/li>\n\n\n\n<li>workers with children (without age limit) <strong>with disabilities <\/strong>under Law. no. 104\/1992;<\/li>\n\n\n\n<li><strong>severely disabled<\/strong> workers under Law. no. 104\/1992;<\/li>\n\n\n\n<li>\u201c<strong>caregivers<\/strong>\u201d;<\/li>\n\n\n\n<li>those who benefit from <strong>leave<\/strong> under Law. no. 104\/1992.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Compulsory reporting methods and deadlines<\/strong><strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The names of workers under agile working must be reported <strong>within five days<\/strong> of signing the agreement, via the <strong><em>cliclavoro.gov.it<\/em><\/strong> platform. The Ministry of Labour and Social Policies provided a new procedure for <strong>mass submission<\/strong>, through an Excel file made available on the platform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Failure to submit the report or late submission will result in administrative penalties against the employer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The mandatory report for at-risk workers carrying out agile working without an individual agreement with a deadline by 31 March 2023, will be sent in &#8220;simplified&#8221; mode <strong>by 31 January 2023.<\/strong> After this date, the ordinary mode will be required.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Remote working proved to be widely used tool during the Covid-19 pandemic, to comply with interpersonal distancing practices and protect \u201cat-risk\u201d employees.
