{"id":3365,"date":"2022-04-20T11:13:12","date_gmt":"2022-04-20T09:13:12","guid":{"rendered":"https:\/\/www.hrcapital.it\/observatory\/ispettorato-nazionale-del-lavoro-prime-indicazioni-circa-le-nuove-disposizioni-in-materia-di-tirocini-extracurricolari\/"},"modified":"2022-05-27T15:43:46","modified_gmt":"2022-05-27T13:43:46","slug":"national-labour-inspectorate-first-instructions-about-the-new-provisions-on-extracurricular-internships","status":"publish","type":"post","link":"https:\/\/www.hrcapital.it\/en\/observatory\/national-labour-inspectorate-first-instructions-about-the-new-provisions-on-extracurricular-internships\/","title":{"rendered":"National Labour Inspectorate: first instructions about the new provisions on extracurricular internships"},"content":{"rendered":"\n<p>In note no. 530 of 21 March 2022, the National Labour Inspectorate (&#8220;<strong><em>INL<\/em><\/strong>&#8220;) has provided some clarifications on extra-curricular internships, particularly the new provisions introduced by Law no. 234\/2021 (&nbsp; &#8220;<strong><em>Budget Law 2022<\/em><\/strong>&#8220;).&nbsp;<\/p>\n\n\n\n<p>Following the provisions of paragraph 720 of Art. 1 of the Budget Law, the INL states that the internship is <em>&#8220;<strong>an educational path that alternates between study and work<\/strong>, for guidance and vocational training, to improve the match between labour supply and demand. <strong>If it is functional to achieving a formally recognised qualification, the internship is defined as curricular.&#8221;<\/strong><\/em><em><\/em><\/p>\n\n\n\n<p>Guidelines that Government and the Regions must follow within 180 days from the entry into force of the Budget Law 2022, for drafting and disseminating a new shared agreement on extra-curricular internships, are listed below:<\/p>\n\n\n\n<ul class=\"wp-block-list\" type=\"a\"><li>revising the regulations on internships which requires the <strong>establishment <\/strong>of extra-curricular internships <strong>should be limited to people with difficulties of social inclusion;<\/strong><\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>guaranteeing an <strong>adequate participation allowance<\/strong>, a <strong>maximum duration<\/strong> that includes possible extensions, and <strong>maximum internships that can be established<\/strong> based on the company size;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>defining essential levels of <strong>training <\/strong>for the intern, and providing skills certification at the end of the training;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>defining a <strong>minimum quota of interns<\/strong> to be recruited from among those already in place before taking new ones;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>actions and procedures to prevent and counter a distorted use of the measure<\/strong>, by identifying the intern working methods.<\/li><\/ul>\n\n\n\n<p>In addition to future provisions, the Budget Law has includes several principles that have been in force since its entry into force:<\/p>\n\n\n\n<ul class=\"wp-block-list\" type=\"a\"><li><strong>participation allowance<\/strong>: failure to provide an adequate allowance, under the guidelines, shall result in the offender being charged with <em>\u201can <strong>administrative sanction<\/strong> of an amount proportional to the offence seriousness, <strong>ranging from a minimum of \u20ac1,000 up to \u20ac6,000\u201d;<\/strong><\/em><\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>fraudulent internship use: <\/strong>an internship is not identified as having an employment relationship and cannot replace an employee. If the internship is carried out fraudulently<em> <\/em><strong>the host company shall be punished with a &#8220;<em>fine of \u20ac50 for each intern involved and each day of internship&#8221;<\/em><\/strong>. This is without prejudice to &#8220;<em> recognising the existence of an employment relationship at the intern&#8217;s request, from the time of the judicial decision<\/em>&#8220;.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>communication to the Employment Centre<\/strong>: the <strong>obligation<\/strong> for the electronic reporting of the establishment of an internship <strong>only concerns extracurricular internships<\/strong>.
