The form reflects the changes introduced by the 2026 Budget Law concerning the allocation of statutory severance pay (TFR) and enrolment in supplementary pension schemes and replaces the previous TFR2 form for employees covered by the new rules.

The TFR3 form and the new supplementary pension rules

Law No. 199/2025 (2026 Budget Law) amended Article 8 of Legislative Decree No. 252/2005, introducing, with effect from 1 July 2026, a new automatic enrolment mechanism for supplementary pension schemes for private-sector employees entering employment for the first time.

One of the main changes concerns the deadline for employees to express their wishes regarding the allocation of TFR and enrolment in a supplementary pension scheme: whereas the previous rules allowed six months, the new system provides for a deadline of 60 days from the date of hiring. The consequences of failing to make a choice also change. While the previous tacit-consent mechanism involved the tacit transfer of future TFR accruals, automatic enrolment under the new rules generally entails the transfer of the full TFR amount, together with employer and employee contributions at the rates set by the agreements or collective bargaining agreements applicable to the employment relationship.

However, the TFR3 form serves a broader purpose than simply recording the choice regarding the allocation of statutory severance pay. Through the form, employees also provide information on any previous choices concerning supplementary pensions and the allocation of TFR.

Options for employees entering employment for the first time

For employees entering employment for the first time, the new rules provide for automatic enrolment in the collective pension scheme identified by the applicable agreements or collective bargaining agreements, including local or company-level agreements. Where more than one pension scheme is available, contributions are allocated to the scheme with the highest number of members among the company’s employees, unless otherwise agreed at company level. Where no agreement or collective bargaining agreement identifies the relevant pension scheme, automatic enrolment takes place in the designated fallback supplementary pension scheme, namely the COMETA Fund.

Employees nevertheless retain the right to make a different choice within 60 days of hiring. Specifically, they may opt out of automatic enrolment and allocate future TFR accruals to a supplementary pension scheme of their choice, or elect to retain TFR under the arrangements set out in Article 2120 of the Italian Civil Code. In the latter case, future TFR accruals remain with the employer or, where the relevant conditions are met, are paid into the INPS Treasury Fund. This choice is not irreversible: employees may subsequently decide to allocate future TFR accruals to a supplementary pension scheme.

Where permitted by the applicable agreements, the TFR3 form also allows employees to allocate a percentage of future TFR accruals to the pension scheme designated for automatic enrolment, rather than the full amount. The form also provides for the statutory option not to pay employee contributions where gross annual remuneration is lower than the annual amount of the social allowance. In such cases, employees may declare, within 60 days of hiring, that they do not wish to pay their own contributions to the supplementary pension scheme.

Rules for employees with previous employment

For employees who have previously been employed, the TFR3 form takes account of their pension position before the new employment begins. In these cases, the choices previously made regarding supplementary pensions and TFR are particularly relevant.

Where an employee has not already joined a supplementary pension scheme to which all or part of their TFR is allocated, the new automatic enrolment mechanism does not apply. TFR therefore continues to be governed by Article 2120 of the Italian Civil Code and, where required, is paid into the INPS Treasury Fund, without prejudice to the employee’s right to join a supplementary pension scheme at a later date.

Conversely, where an employee has already joined a supplementary pension scheme to which all or part of their TFR is transferred, they must specify, within 60 days of the new hiring date, the pension scheme to which future TFR accruals should be allocated. If no choice is made, the automatic enrolment mechanism applies in accordance with the criteria set out in the new rules.

The TFR3 form therefore enables the new employer to establish the choices made by the employee during previous employment relationships and correctly determine the allocation of TFR relating to the new employment relationship.

Employer information obligations

The new system places particular emphasis on employers’ information obligations. Upon hiring, employees must receive information on the pension scheme identified by the applicable agreements or collective bargaining agreements, how automatic enrolment works, the options they may exercise within 60 days, and the various alternatives for allocating TFR.

The TFR3 form includes a specific declaration in which employees acknowledge receipt of this information. In the final section of the form, the employer, in turn, confirms that it has provided the required information, obtained and retained the employee’s declaration, and supplied the employee with a copy.

In the event of automatic enrolment, once the 60-day period has elapsed, the employer notifies the relevant supplementary pension scheme and begins making the corresponding payments from the following month. The first payment must also include the amounts due for the period between the employee’s hiring date and the first payment, as automatic enrolment takes effect from the date of hiring.

Towards a digital form

Finally, the decree provides for the future digital management of the TFR3 form. From a date to be announced on the Ministry of Labour and Social Policies’ website, the form may be completed online and, where applicable, notified to the employer.

The technical arrangements for completion, notification, processing by the employer and data retention will be established by a subsequent directorate decree. Until the digital procedure becomes operational, the obligations under the new rules to obtain and retain the declaration and provide the employee with a copy therefore remain in place.

By the Interministerial Decree of 4 September 2026, the Ministry of Labour and Social Policies, in agreement with the Ministry of Economy and Finance, adopted the new TFR3 form for private-sector employees hired on or after 1 July 2026.
