How does a transnational secondment take place?

The regulation on transnational secondment to Italy is currently contained in Italian Legislative Decree No. 136/2016, which defines the secondment as the temporary transfer  of an employee to another company – or to another location of the same company – located in another State.

The company that wants to second one of its employees to Italy remains responsible for the financial, regulatory and contributory treatment in favor of the employee. Among the various obligations to be complied with, it is necessary to make an electronic communication on the Cliclavoro webportal no later than the day before the start of the secondment and to appoint a representative of the seconding company in Italy.

What documents are needed to hire an expatriate?

In order to hire an expatriate worker in Italy, it is necessary to submit:

  • a valid identity document (passport from the country of origin or Italian or EU ID card);
  • a valid residence permit, or if it has expired, the receipt of application for its renewal is sufficient;
  • an Italian tax code.
