Life annuity: INPS intervenes to align with the Court of Cassation’s ruling on limitation periods

With judgment no. 22802 of 7 August 2025, the Italian Supreme Court (Court of Cassation) ruled on the criteria for determining when limitation periods begin to run for applications to establish a life annuity, pursuant to Article 13, paragraphs 1 and 5, of Law no. 1338/1962, revising its previous case law on the matter.

Following the decision of the Joint Chambers, INPS issued Circular no. 141 of 12 November 2025, providing its own clarifications on the content of the judgment and fully replacing Circular no. 48 of 24 February 2025. The latter had been issued shortly after the entry into force of Law no. 203/2024 (the so-called “Labour-related Act”), which, through Article 30, introduced paragraph 7 of Article 13, granting workers the right to establish a life annuity entirely at their own expense.
