Extension of Smart Working Deadlines

Good morning everyone, and welcome to a new HR Capital Tip! 

Law no. 85 of the 3rd of July 2023, has extended the so-called “Lavoro Decree,” which provides the right for vulnerable workers in both the public and private sectors to work in smart working until the 30th of September 2023.  

The same right has also been extended until the 31st of December 2023 for employees who have at least one child under the age of 14, provided, however, that there is no other parent in the household who benefits from income support benefit and that there is no non-working parent. 

This extension has also been granted for employees who, following an assessment by a competent doctor, are considered more exposed to the risk of COVID-19 due to their age or specific health conditions. 

In all cases, smart working must be compatible with the nature of the work. 

For employers, the obligation to transmit mandatory communications regarding smart working remains unchanged, and this should be done through the normal procedure on the ministerial portal “Cliclavoro.”
